1. How much does it cost to apply to the Board of Adjustment?

A $100 fee is collected to apply to the Board of Adjustment.

2. Can the board grant a variance for construction in the right-of-way?

The Board of Adjustment cannot and will not grant variances for construction in the right-of-way.

3. What if I disagree with the Board of Adjustment’s decision?

Any party or individual disagreeing with the decision of the Board of Adjustment may appeal such decision to the State District Court by filing a petition that sets forth why the decision is illegal, in whole or part, and specifying the grounds of the illegality. The City Commission cannot and will not hear appeals from the Board of Adjustment.
